By submitting this application, I certify that I have read, met and agreed to all the terms, conditions and discussions provided in the Cardmember undertaking. I request that The American Express SmartEarnTM Credit Card account(s) to be opened for me as requested.
  1. I hereby give an explicit consent to American Express Banking Corp. (“AEBC/American Express”) to (a) share my information with relevant credit reference agencies, for the purpose of conducting credit check and (b) to contact me on email and mobile number shared by me to (i) inform me if I am eligible for any American Express Card(s) and (ii) to collect any additional details from me, even if I am registered with the National Customer Preference Register (NCPR) and opted out of receiving all promotional calls and messages.
  2. I hereby give an explicit consent to AEBC for collecting/downloading and verifying my details with/from CKYCR registry basis information/details provided by me. In the case the details provided by me does not match with CKYCR registry, I shall provide the revised correct information/details to AEBC.
  3. I hereby confirm that I am a Resident as defined under the Indian Income Tax Act, 1961 and I hereby declare that I will notify AEBC, if there is a change in my residential status.
  4. I hereby give an explicit consent to AEBC to verify information provided by me and to receive and exchange information about me including requesting reports from my bank, consumer credit, social media, reference schemes or credit information companies/bureaus and Credit Information Companies (CIC) as authorised by Reserve Bank of India. I authorize AEBC and its affiliates/representatives/agents to contact the aforesaid sources for information pertaining to me at any time and to use information provided by me and information obtained from aforesaid sources for operational, administrative and to service the card account(s). I declare and undertake that the card(s) issued to me, if used overseas shall be used strictly in accordance with the extant Exchange Control Regulations issued by the Reserve Bank of India (RBI).
  5. I hereby agree and confirm that in the event I exceed my entitlements as per the Exchange Control Guidelines of the RBI, I undertake to bring the same immediately to the notice of AEBC, in writing. Obtaining any approval from RBI for excess foreign exchange spending shall be my responsibility and I shall bring the same immediately to the notice of AEBC.
  6. I understand that the basic cardmember will be liable for all charges incurred on the basic card, any additional card and any supplementary card. The Supplementary Cardmember accepts joint and several responsibility for all charges incurred on the supplementary card issued to him/her.
  7. I hereby explicitly agree and confirm that AEBC has shared the Most Important Terms and Conditions (MITC) for the American Express® card(s) with me in compliance of the RBI master circular on credit card operations of banks and I have read, understood and I accept the MITC.
  8. I understand that AEBC may decline any card(s) application at its absolute and sole discretion and I am aware that AEBC strongly respects and honours customer privacy and I am aware AEBC Privacy policy is available for viewing on https://www.americanexpress.com/in/content/privacy-statement.html. I am aware and understand that (a) the additional factor of authentication is mandated by RBI vide letter DPSS.PDCONO223/02.14.003/2011-12 dated August 4, 2011 and (b) use of cards for travel and related CNP Transactions without such additional factor of authentication carries security risk and such cards are vulnerable to frauds.
  9. I agree and confirm that in the event of change in my correspondence address due to relocation or any other reason, I will intimate my new address to AEBC within two weeks of such a change. I understand that in the event of change in the address mentioned as per proof of address, I will submit fresh proof of address to AEBC within a period of three months of such a change.
  10. I confirm that the information/details provided herein are true and correct as of date.
  11. I hereby agree and confirm that I have read and understood the AEBC privacy policy available and updated from time to time on https://www.americanexpress.com/india/microsite/privacy_statement/ and I hereby explicitly agree to the same.
  12. I understand and agree that the first payment made on my Amex card will be made via a Know Your Customer (KYC)-complied account as maintained by me with another Scheduled Commercial Bank in India. I also understand that in the event I make the first payment via cash towards my Amex Card, my card account will be permanently cancelled without any further notice and will not be eligible for reinstatement.
